Is Canada Still Subject To A Democratic Constitution?
Or is it now a Managerial Society in which elites find loopholes in constitutional legislation to accumulate more power over the masses?
A Constitutional Expert Speaks Out
Professor Bruce Pardy, https://law.queensu.ca/directory/bruce-pardy, addresses in this podcast key questions posed by journalist Rupa Subramanya about Canada’s courts. They discuss legal interpretations relating to cases brought forth by citizen groups about the constitutionality of the many mandates and lockdowns used during the pandemic era.
Constitutional Law is not as straightforward as I can hoped!
This interview has dispelled my naïveté about Constitutional Law. When I have read the Canadian Charter of Rights and Freedoms in the past, the violations of those statues by “the authorities” seemed straightforward and incontestable. Nothing can be further from the truth.
I am left with a feeling of pessimism and hopelessness.
Less Government is the only Conceivable Remedy
I share Dr. Pardy’s “great concern” about this country’s future. To paraphrase one of his comments ….
‘…. managerial societies tend to go in one direction over time - they expand their size, cost and scope of authority. The more this happens, the harder it becomes to reverse course.’
I have been a Less Government Advocate since the late 1970s and became more active in promoting this cause since 2007. I have witnessed the steady erosions of our Freedoms Of Choice as our governments have incrementally built what Dr. Pardy refers to as the Managerial State.
Bruce correctly stated that the destiny of Canada is in the hands of our citizens as voters. Unfortunately, most citizens have perennially voted for more government, not less. The fact that ALL of the major political parties - the BORG (blue, orange, red and Green) - feature election platforms that promote more government is a reflection of the “will of the Canadian people” collectively.
The Collective Will is sinking the Canadian Ship.
Bruce claims that we (all Canadians) have a lot of learning and discussing to do is we are to have any chance to stop the growth of the Managerial State. However, too many citizens refuse to openly discuss/debate certain topics such as religion, politics, climate change and pandemic policies. Fortunately, there is a growing number of citizens who are the exception.
It is my hope that every citizen who privately or publicly shares Bruce’s concern will watch this interview, begin to follow Bruce’s work, and encourage others to engage in open dialogue on this topic in all of its dimensions.
