“judge shopping”❓
In America, judge shopping is an increasingly common practice defined as “where plaintiffs strategically file lawsuits before judges they view as more favourable to their case.” Is this in Canada too❓
A corruption of justice❓
I admit to knowing very little about legal matters, or our judiciary systems here in Canada, or in the USA for that matter. The idea of “judge shopping” never occurred to me until reading The Epoch Times story: Injunction Showdown published today.
Would Judge Judy be on the shopping list of Democrats?
Some interesting statements by influential people appeared in this article.
President Donald Trump is calling out lower courts’ use of nationwide injunctions, or orders that apply across the country and block administration policies. In a post to TruthSocial on March 20, he said, “Unlawful Nationwide Injunctions by Radical Left Judges could very well lead to the destruction of our Country!”
Three of the nationwide injunctions against Trump’s administration are the subject of an appeal with the Supreme Court. Acting Solicitor General Sarah Harris asked the court in a brief to say “enough is enough” for nationwide injunctions. “Universal injunctions have reached epidemic proportions since the start of the current Administration,” Harris said.
The orders have mostly come from judges appointed by a president of the opposing party of the administration. That trend, the study said, was fueled by “judge shopping,” where plaintiffs strategically file lawsuits before judges they view as more favorable to their case.
On TruthSocial, Trump said “the danger is unparalleled” and that “these Judges want to assume the Powers of the Presidency, without having to attain 80 Million Votes.” He added that if “Justice Roberts and the United States Supreme Court do not fix this toxic and unprecedented situation IMMEDIATELY, our Country is in very serious trouble!”
Trump and others have targeted judge shopping. Last year, the Judicial Conference of the United States encouraged random judge assignment. Other proposals have included eliminating nationwide injunctions or having a panel of judges that reviews cases where nationwide relief is requested.
DOGE the Justice Systems
The #1 problem that all Western democracies have is Too Much Government.
The evidence?
News followers witness numerous and never-ending conflicts that between institutions and institutions, institutions and individuals, institutions and business enterprises, institutions and disgruntled community groups (the Trucker convoy, for instance) and between thousands of organized NGO groups representing a diverse range of special interests who lobby governments for money or unearned privileges.
The erosion of Democracy
If “judge shopping” gives one party an advantage over another in a legal matter, how is this justice❓
If one party has access to public funds and the other does not, how is this fair❓
If the Justice System is a public monopoly that controls every aspect of determining and administering “justice”, can its leaders and officials be trusted to remain dedicated in ethically delivering service to the public they are employed to serve❓ Can they be trusted to reject all self-enrichment temptations associated with the powers of their office❓
Winston Churchill (1874 -1965)
“Democracy is the worst form of government, except for all the others.”
The statement was expressed in the 1950s when governments were a relatively small segment of society and its economy. I wonder what he would say today after seeing how large and powerful the four levels of government have become since his day.
English historian, Lord John Acton (1834-1902)
Lord Acton warned of the dangers of Too Much Government long ago.
“Power tends to corrupt and absolute power corrupts absolutely. Great men are almost always bad men, even when they exercise influence and not authority; still more when you superadd the tendency of the certainty of corruption by authority.”
“Despotic power is always accompanied by corruption of morality.”
“Authority that does not exist for Liberty is not authority but force.”
“Everybody likes to get as much power as circumstances allow, and nobody will vote for a self-denying ordinance.”
“Absolute power demoralizes.”
The Acton Institute, named after Lord Acton, operates as a think tank whose mission is to promote a free and virtuous society characterized by individual liberty and sustained by religious principles.
DOGE is America’s answer to Too much Government.
The weaponization of the American Justice System has been on Trump’s mind for some time. I am wondering what he has up his sleeve to curb its excessive powers and how DOGE will be legally empowered to make the needed corrections.
As an average Canadian living through the past ten years of enormous abuses of power with no accountability by the Trudeau/Singh power bromance, I am at a loss to what can be done here.🤷🏼🥺
Thanks Gene According to our sources in order to achieve registry of our lawsuit against these corrupt councils breaching our trust and swearing support for NGOs we are walking on glass.
www.watersheddebacle.ca We must make an effort regardless of the hurdles. At least we have great people/landowners out there with their eyes open and joining us. We welcome input from victims of deceitful councils info.watersheddebacle@gmail.com
Gene, a timely article. In the US it seems the judges have been weaponized by the DS against Trump actions.
In Canada the prosecutors and some judges are following the same playbook. The assistant in Ottawa who is going after the convoy public faces is a prime example. His vendetta is abusive of his office on a number of actions. He also has the blessings of Doug Ford on these issues. Ford has been compromised in his position as a Conservative leader. He has publicly endorsed Carney as the one best to represent Canada !
The evidence is there to be seen. The answer is to recognize the upcoming election issues. Canada or a globalist agenda ! Chose wisely !
